GENERAL TERMS AND CONDITIONS – BRUGGE BANDEN MOBIEL

1. Scope

These General Terms and Conditions apply to all quotations, orders, services, and invoices issued by Brugge Banden Mobiel, unless otherwise agreed in writing.

By accepting a quotation, ordering a service, signing the work order, or paying an invoice, the customer acknowledges having read and accepted these General Terms and Conditions.

2. Services

Brugge Banden Mobiel provides mobile tyre services, including tyre fitting, tyre removal, wheel balancing, tyre repairs, tyre replacement, roadside assistance (breakdown service), and other tyre-related services for passenger cars and light commercial vehicles.

3. Quotations and Prices

All prices include VAT unless stated otherwise.

Quotations are valid for 14 days from the date of issue.

Brugge Banden Mobiel reserves the right to adjust prices if the scope of the work changes or if supplier prices change before the service is carried out.

4. Payment Terms

Unless otherwise agreed in writing, all invoices are payable immediately upon completion of the service or no later than the due date stated on the invoice.

Roadside assistance (breakdown service) must always be paid immediately after the intervention unless a different payment arrangement has been agreed upon in writing beforehand.

In the event of non-payment by the due date, the following shall automatically apply, without prior notice of default:

  • Late payment interest at 10% per annum;

  • A fixed compensation of 15% of the outstanding amount, with a minimum of €75.

A dispute concerning part of an invoice does not suspend the obligation to pay the undisputed portion.

5. Debt Collection

If an invoice is not paid on time, Brugge Banden Mobiel reserves the right to transfer the file to an external debt collection agency.

Any additional collection costs shall be borne by the customer, insofar as permitted by law.

6. Retention of Title

All tyres, parts, and materials supplied remain the property of Brugge Banden Mobiel until the invoice has been paid in full.

7. Specially Ordered Tyres

Tyres specially ordered for the customer cannot be cancelled, exchanged, or returned after delivery or installation, except in the event of a manufacturing defect or where required by law.

8. Complaints

Complaints must be submitted in writing, stating the reasons, within five days after delivery or completion of the work.

Before the customer engages a third party to carry out repairs, Brugge Banden Mobiel must first be given the opportunity to inspect and, if necessary, remedy the issue.

Costs incurred through third parties without the prior consent of Brugge Banden Mobiel will not be reimbursed.

9. TPMS

Brugge Banden Mobiel shall not be liable for damage to TPMS sensors resulting from wear and tear, corrosion, age, or pre-existing defects.

10. Wheel Alignment

Brugge Banden Mobiel does not perform wheel alignment services.

If it becomes apparent during the work that a wheel alignment is necessary, the customer will be informed accordingly.

11. Photographs

Brugge Banden Mobiel reserves the right to take photographs of tyres, wheels, and the condition of the vehicle before, during, and after the intervention.

These photographs may be used as evidence of the vehicle's condition and of the work performed.

12. Cancellation

If an appointment is cancelled less than 24 hours before the scheduled intervention, Brugge Banden Mobiel reserves the right to charge an administrative fee of €40.

13. Force Majeure

Brugge Banden Mobiel shall not be liable for delays or cancellations caused by force majeure, including but not limited to adverse weather conditions, accidents, illness, technical failures of the service vehicle, delivery delays, or any other circumstances beyond its reasonable control.

14. Liability

The liability of Brugge Banden Mobiel is limited to the value of the service performed or the amount covered by its insurer.

Brugge Banden Mobiel shall not be liable for damage resulting from normal wear and tear, hidden defects in the vehicle, unsuitable tyres, or improper use by the customer.

15. Governing Law and Jurisdiction

All agreements shall be governed exclusively by Belgian law.

Any disputes shall fall under the exclusive jurisdiction of the courts of Bruges, Belgium.

16. Place of Intervention

The customer is responsible for making the vehicle available in a safe, accessible, and suitable location for the work to be carried out.

If the intervention cannot be performed due to circumstances beyond the responsibility of Brugge Banden Mobiel—such as the customer's absence, an inaccessible vehicle, insufficient working space, or other circumstances not communicated in advance—Brugge Banden Mobiel reserves the right to charge the travel costs, lost working time, and any additional expenses incurred.
